Waiver, Release, Hold Harmless, and Indemnification Agreement

PLEASE NOTE OUR PLAY AREA IS ONLY FOR CHILDREN AGED 0 MOS TO 8 YEARS.

As Consideration for being allowed to enter the play area and/or Participate in any party and/or program at Mellow & Play Café LLC the undersigned, on his or her behalf, and on the behalf of the Participant(s) identified below, acknowledges, appreciates, understands, and agrees to the following:

1. I represent that I am the parent or legal guardian of the Participant(s) named or I have obtained permission from the parent/legal guardian of the Participant(s) named to execute this agreement on their behalf.
2. I acknowledge and understand that there are risks associated with participation in Mellow & Play Café LLC activities and the use of the play area and inflatable equipment including but not limited to: contusions, fractures, scrapes, cuts, bumps, paralysis, or death.
3. I, for myself and the Participant(s) named, willingly assume the risks associated with participation and accept that there are also risks that may arise due to OTHER PARTICIPANTS which I also willing assume.
4. I agree that the Participant(s) named, and I shall comply with all stated and customary, terms, posted safety signs, rules, and verbal instructions as conditions for participation in any party and/or program at Mellow & Play Café LLC.
5. I, for myself, the Participant(s) named, our heirs, assigns, representatives, and next of kin agree to hold harmless and indemnify the independent owner of the Mellow & Play Café LLC facility, their predecessors, parents, subsidiaries and affiliates, officers, and employees from any and all injuries, liabilities or damages from participation.
6. I additionally agree to indemnify the independent owner of this Mellow & Play Café LLC facility, their predecessors, parents, subsidiaries and affiliates, officers, and employees for any defense cost or expense arising from any and all claims, injuries, liabilities or damages arising from participation.
7. I understand the noise level from the blowers that keep the the bounce houses inflated may create higher than normal decibels.
8. I am of physical ability to participate and am legally competent to understand and complete this agreement. I hereby execute this agreement without coercion.
9. I understand that photographs may be taken of myself & mychildren and used on Mellow & Play Cafes social media accounts.
10. I understand I may periodically receive promotional e-mails from Mellow & Play Cafe (we do not sell our subscriber list).  I further understand I am able to unsubscribe from any email subscriptions at any time and it will not effect me negatively.  Benefits of staying on the mailing list includes early notification of events, discounts and specials.

The Rules of Mellow & Play Café LLC

To keep everyone safe, we have a few rules:

• Parents must supervise their children at all times.
• Kids and adults take off your shoes before entering the play area. Everyone must wear socks in the Play Area. We have socks you can buy if you forget yours.  Please note that the floors outside of the play area could be slippery when wearing socks.  Use caution when walking in other areas of the building outside of the Play Area.  It's suggested you put your shoes back on when not utilizing the Play Area.
• Ensure you remove any sharp object or jewelry. It is suggested that you remove eyeglasses as well, for the safety of your child as well as others, but we do recognize this may be difficult for some. Therefore, eyeglasses can be worn but at your own risk/liability.
• Parents must sign a waiver prior to children playing (please read above).
• Absolutely no rough play, flips, or diving allowed on inflatables.
• No climbing or hanging on the walls or roof of inflatables.
• No food, drinks, gum, or candy allowed in the Play Area.
• Children who have been recently sick are requested not to enter the facility (until 48 hours AFTER the last sign of symptoms).
• Mellow & Play Café LLC is a non-smoking, non-vaping facility.  
• If you are eating in the seating area, please keep it clean – if there are any spills, let us know – we’ll be happy to clean them up so no one slips.
• Mellow & Play Café LLC is not responsible for lost, stolen, or damage to personal property brought into or stored on the premises.
• Persons not following the safety rules will be asked to leave.
• To the most extent possible, staff will be present in the play area/reception area to enforce our rules.. We are unable to provide "babysitting" services at this time. It is the parents/guardians responsibility to ensure their children are following the rules for everyone's enjoyment and safety.
